1. This is beta software
DeSpy is provided to you as a pre-release "beta" build for testing and evaluation only. It is not a finished product. It is incomplete, still under active development, and known to contain bugs and defects. Features may be added, changed, broken, or removed without notice, and a build may stop working at any time. It is not intended for production use or for any situation where a failure to detect surveillance, or any other malfunction, could cause harm, loss, or danger. Do not rely on DeSpy as your sole means of protection.
2. Back up your data — your responsibility
You are solely responsible for backing up your data before installing or running the beta. Before you install DeSpy on any device, make a complete and verified backup of that device. Do not install or run the beta on:
- a phone, tablet, or computer that holds data you cannot afford to lose or that is not backed up;
- a primary or work device you depend on;
- a device holding sensitive, confidential, regulated, or irreplaceable information.
Prefer a spare or secondary device. Assume that any device you test on could need to be wiped and restored from backup.
3. No warranty
The beta is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the software will be uninterrupted, timely, secure, accurate, error-free, or that defects will be corrected. No advice or information you obtain from us or the software creates any warranty not expressly stated here.
4. No liability for device or data harm
To the fullest extent permitted by law, DeSpy and Global Digital Forensics, Inc. are not responsible or liable for any problem, damage, or loss arising from your use of the beta, including but not limited to:
- any issue with any phone, tablet, or other mobile device it runs on — including crashes, boot loops, reduced battery life or performance, overheating, being rendered unusable ("bricked"), or the need to reset or restore it;
- any issue with any computer it runs on or interacts with — including instability, data corruption, or configuration changes;
- loss of, or damage to, any data, files, photos, messages, or settings on any device;
- missed, incorrect, or false detections (including failing to detect surveillance that is present, or flagging something that is not); and
- any indirect, incidental, special, consequential, or punitive damages, or any lost data, profits, or goodwill.
You accept these risks and agree that participation in the beta is entirely at your own risk. Nothing in this Agreement excludes liability that cannot be excluded under applicable law; where liability cannot be fully excluded, it is limited to the minimum permitted by that law. This section survives the end of your participation.
5. Eligibility and conduct
You must be old enough to form a binding agreement in your jurisdiction and must own, or have explicit permission to test on, every device you use with the beta. DeSpy is a tool for detecting surveillance and protecting people. You must never use it, or information it produces, to surveil, stalk, harass, or harm anyone, or for any unlawful purpose. Misuse ends your access immediately and may be reported to the authorities.
6. Confidentiality and access
Beta builds, download links, and any non-public information about them are confidential. Your personal download link is unique to you — do not share it or redistribute the software. We may change, suspend, or revoke beta access, or discontinue the beta, at any time and for any reason.
7. What we collect and that we save it
We save the information you submit. When you apply and accept this Agreement, we store your application details (name, email, and the other fields on the form) together with a record that you accepted this Agreement, the version you accepted, and the date and time — kept as evidence of your consent. This data is processed under our Privacy Policy; we never sell or share it and set no cookies or trackers. You can erase your data at any time using the data removal form. 8. Duration, changes, and contact
This Agreement applies for as long as you take part in the beta and its risk, warranty, and liability terms continue afterward. We may update it; the current version and date are shown at the top of this page, and material changes will be reflected in a new version you accept on your next application.
