1. About these Terms
These Terms of Use are a legal agreement between you and DeSpy ("DeSpy", "we", "us", "our") covering your access to the DeSpy website and, where you choose to participate, the DeSpy beta program. By using the site or applying to the beta, you agree to these Terms. If you do not agree, please do not use the site or the beta program.
The registered legal entity that operates DeSpy and its postal address are recorded below and referenced wherever these Terms require them: Global Digital Forensics, Inc., PO Box 431, Crystal Beach, FL 34681-0431. Our trading name is DeSpy and our website is despy.app.
2. The website and its content
The DeSpy website is provided for general information about DeSpy and its privacy tools. We work to keep the content accurate and current, but we make no promise that it is complete, error-free, or up to date, and we may change or remove any part of it at any time.
- Nothing on the site is legal, security, or professional advice, and you should not rely on it as a substitute for advice suited to your own situation.
- Descriptions of features, availability, timelines, and the beta program are indicative and may change as the product develops.
- Your use of the site is at your own discretion and risk, subject to the disclaimers in section 9.
3. Information and submissions
Some parts of the site let you send us information — for example the "Join the privacy movement" box on the homepage and the beta application form. Any personal data you provide is handled in accordance with our Privacy Policy, which explains what we collect, why, the legal bases we rely on, how long we keep it, and the rights you have.
In short, and without replacing the Privacy Policy:
- The beta application form collects your full name and email (required), your reason for applying (required), and optionally your organization, the platforms you want to test (iOS and/or Android), your two-letter country, and whether you opt in to marketing email. You must tick the privacy-notice and beta-terms consent boxes to submit.
- To protect the form against abuse we also store technical details described in the Privacy Policy, including a salted one-way hash of your IP address — your raw IP address is never stored.
- The homepage email box stores what you type only on your own device (browser localStorage) and only if you allowed the optional "functional" category; it is never sent to any server. See the Cookie Notice.
You are responsible for making sure the information you submit is accurate and that you are entitled to share it. Do not submit anyone else's personal data without a proper basis to do so.
4. Third-party links
The site may link to third-party websites or resources. We provide those links for convenience only. We do not control and are not responsible for third-party sites, their content, or their privacy practices, and a link does not imply our endorsement. When you follow a link away from despy.app, the terms and policies of that other site apply.
5. The DeSpy beta program
The beta program gives approved testers early access to pre-release DeSpy builds so we can gather feedback and improve the product. Participation is optional, is offered at our discretion, and is subject to these Terms and to the beta-terms and privacy-notice versions in effect when you apply (currently version 2026-07-15).
5.1 Pre-release software, provided "AS IS"
Beta builds are unfinished and provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. Beta software may contain defects, may be unreliable or unavailable, may change or be withdrawn, and may not perform as a final release would. Do not rely on a beta build for any safety-critical, high-risk, or otherwise consequential purpose.
5.2 Confidentiality of beta builds and credentials
Unless we clearly state otherwise in writing, beta builds, download links, access tokens, credentials, and any non-public information we share with testers are confidential. As a tester you agree that you will not:
- redistribute, publish, resell, sublicense, or otherwise make a beta build available to anyone who is not an approved tester;
- share, transfer, or expose your download link, access token, or credentials — they are personal to you;
- reverse-engineer, decompile, or disassemble a beta build for the purpose of redistribution or of building or assisting a competing or derivative product, except where such a restriction is prohibited by applicable law; or
- publicly disclose non-public details of unreleased features without our permission.
Your approved download link is issued to you individually. It expires 14 days after it is minted and allows a limited number of downloads; we log each download using a salted IP hash, your user-agent, and a timestamp (never your raw IP), as described in the Privacy Policy.
5.3 Feedback
If you send us feedback, bug reports, or suggestions about a beta build, you grant us a non-exclusive, royalty-free, worldwide right to use that feedback to operate and improve DeSpy, without obligation or compensation to you. Please do not include confidential information of your own or of third parties in your feedback.
6. Acceptable use and anti-misuse
DeSpy exists to detect surveillance and help protect people. Using it — or the website, the beta program, or any information you gain through them — to do the opposite is a serious breach of these Terms. You must not use DeSpy or anything we provide to:
- surveil, track, monitor, profile, stalk, harass, intimidate, or otherwise harm any person, whether or not that person is aware;
- locate or expose a person against their wishes, or facilitate domestic abuse, coercive control, or any form of unlawful monitoring;
- defeat, circumvent, disable, or weaken another person's privacy, security, or anti-surveillance protections;
- break any applicable law, infringe anyone's rights, or gain unauthorized access to devices, accounts, systems, or data; or
- probe, scan, overload, or disrupt the website, the beta infrastructure, or our security controls, or attempt to bypass rate limiting or access restrictions.
You are responsible for using DeSpy lawfully and ethically, and only in ways consistent with its protective purpose. Where we become aware of a credible threat to a person's safety, or of use of our service to facilitate stalking, abuse, or other serious harm, we may take proportionate action — including suspending access — and may report the matter to law enforcement or other appropriate authorities.
7. Suspension and revocation of access
The beta program is a privilege we extend at our discretion. We may suspend, limit, revoke, or refuse your access to the site or the beta program at any time, with or without notice, including where we reasonably believe you have breached these Terms (especially section 5 or section 6), where required by law, or to protect testers, the public, or our systems. On revocation you must stop using any beta build in your possession and delete it and its credentials; active download links may be invalidated. Sections that by their nature should survive — including confidentiality, acceptable use, disclaimers, limitation of liability, and governing law — continue to apply after your access ends.
8. Intellectual property
The DeSpy name, logo, website, and software, and all related content, are owned by DeSpy or its licensors and are protected by intellectual-property laws. These Terms do not transfer any ownership to you. For the beta program we grant you only a limited, personal, non-exclusive, non-transferable, revocable right to install and use the beta build for evaluation and feedback, subject to these Terms. All rights not expressly granted are reserved.
9. Disclaimers and limitation of liability
The website and the beta program are provided "AS IS" and "AS AVAILABLE". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the site or beta will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, DeSpy and the entity identified in section 1 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or opportunity, arising out of or relating to your use of — or inability to use — the site, the beta program, or any beta build, even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, such as liability for death or personal injury caused by negligence, or for fraud.
10. Governing law and disputes
These Terms, and any dispute or claim arising out of or in connection with them or your use of the site or the beta program, are governed by the laws of the State of Florida, United States, and the courts of that jurisdiction will have exclusive authority to resolve them, without regard to conflict-of-laws rules. Nothing here deprives you of any mandatory protections available to you under the law of your place of residence.
11. Changes to these Terms
We may update these Terms from time to time. Material changes bump the version string shown at the top of this page and, where these Terms govern beta participation, will be reflected in the beta-terms version recorded against each application. The version in effect when you apply to or use the beta continues to govern that participation until you accept an updated version. Please review this page periodically; continued use of the site after a change means you accept the revised Terms.
